Your dispensing pharmacist decides whether the medicine and circumstances meet the requirements. The Board publishes the emergency guidance.

How to get it

Start with the pharmacy that knows your prescription

  1. Bring your prescription bottle or prescription number to the pharmacy.
  2. Explain that your prescriber is unavailable and ask about an emergency maintenance refill under the declaration.
  3. Let the pharmacist review the medicine and the risk of interrupted treatment. Mention if you are activated emergency response personnel.

Schedule II medicines are excluded. Access depends on the pharmacist's professional judgment and statutory requirements. A qualifying county address alone does not establish personal eligibility or free medicine.

Requirements, declaration & official sources

Declared Florida counties · confirm your county and personal eligibility

The medicine must be essential to life or continued treatment of a chronic condition, and the pharmacist must judge that an interruption would cause harm or serious discomfort.

Schedule II controlled substances are excluded. The pharmacist decides whether the statutory requirements are met; a property in a declared county does not establish personal eligibility.

The ordinary emergency limit is a one-time 72-hour supply. Insulin has separate emergency-refill provisions that do not require a declaration.

Executive Order 26-202 also extends emergency-refill authority to activated state and local emergency response personnel, including outside the listed counties.
